  1. Comply with terms and conditions
    1. By registering as a user of askNextDoor you accept these terms and conditions for using the Service. If you do not accept these terms and conditions, do not use askNextDoor’s Service.
    2. These terms and conditions may be amended in whole or in part by askNextDoor from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of askNextDoor's services represents your agreement to be bound by the terms and conditions as amended.

  2. The Service
    1. AskNextDoor facilitates contact between the asset owner or relevant asset steward (“Item Manager”) a party who is willing to lend an asset (Item) and the hirer (“Hirer”) a party that would hire the asset. Item Manager and Hirer may also be referred to as “Party” in the singular and “Parties” in the plural.
    2. AskNextDoor operates as a virtual service based on internet and phone communication.
    3. AskNextDoor does not own or otherwise provide the physical Items to the Hirer; only information about the Item Manager is provided by askNextDoor.
    4. AskNextDoor does not hire out Items or otherwise participate in the services; only information about individuals or business willing to hire the Items is provided by askNextDoor.
    5. AskNextDoor does not act as an agent for either Item Manager or Hirer.
    6. askNextDoor is being operated by askNextDoor Pty Ltd

  3. Risk
    1. AskNextDoor makes no representations or warranties about the information provided on or through the web application to parties offering items for hire or hiring parties. This includes:
      ~ the accuracy of details provided about each listed Item;
      ~ the availability of the specified Item listed by Item Manager (i.e. the actual Item may be different from the one listed);
      ~ the availability of the listed Item if the Item Manager cancels, withdraws or for any other reason does not provide the Item to the hiring party;
      ~ the accuracy or truthfulness of the information the Hirer has provided to askNextDoor;
      ~ the accuracy or truthfulness of the information the Item Manager provided to askNextDoor.
      ~ the availability of an alternative hiring party if the Hirer cancels, does not show up or does not complete the hire.
    2. AskNextDoor takes no responsibility for loss or damage of the Item to the Item Manager resulting from accident or intentional damage. Any dispute about such issues must be resolved directly between the Item Manager and the Hirer.
    3. AskNextDoor makes its best effort to ensure all information on the website is accurate and up-to-date. However, askNextDoor cannot and does not guarantee that errors do not occur from time to time. Therefore, all information and services are provided on an “as is", “as available" basis. Other than as explicitly stated in these terms and conditions, askNextDoor disclaims all warranties, express or implied, including any warranties of accuracy, completeness, currentness, merchantability or fitness for a particular purpose. AskNextDoor does not warrant that the services will be uninterrupted or error-free and disclaims any warranty or representation regarding availability of service, service levels or performance. askNextDoor will not be liable for any loss or injury arising out of, in whole or in part, askNextDoor’s conduct in procuring, compiling, collecting, matching, reporting or delivering services, reports or information.

  4. Validate and update information
    1. AskNextDoor reserves the right to validate and update all information provided to askNextDoor by the Item Manager and the Hirer.


Hirers Responsibilities

  1. Membership
    1. Hirer may register to, and request an item at, askNextDoor 's website free of charge.
    2. AskNextDoor reserves the right to terminate memberships or decline a Hirer to re-register if that Hirer has breached the terms and conditions.

  2. Registering
    1. As part of registering with askNextDoor, you must provide true, accurate and current information to askNextDoor including full name, date of birth and contact details. A representative of askNextDoor may call or email to verify these details.
    2. You may only register as a Hirer if you are 18 years or older. By registering as a Hirer, you warrant that you can form and commit to a legally binding contract.

  3. Request an Item
    1. When requesting an item, you must accept the terms and conditions as stipulated by the Item Manager.
    2. You permit askNextDoor to pass on your contact details to the Item Manager.
    3. A request is no guarantee that you will be able to hire the Item. A hire is “booked” only if your request is accepted by the Item Manager. Notification of the status of the request may be sent by email, phone or via the askNextDoor website portal.
    4. You are solely responsible for determining the suitability of the requested Item for your needs. If there is any information not specified in the listing that will affect your decision to hire the Item, you should contact the Item Manager to determine those details before requesting the item.
    5. Should your request be accepted by the Item Manager, you commit to Hire the item according to the details provided by the Item Manager of the requested Item and your preferred pick-up and drop-off date and time as specified when requesting the item.
    6. You cannot request an item on behalf of another party.

  4. Item pick-up and agreement with the Item Manager
    1. The Hirer must show up at the location agreed with the rental operator at the date and time agreed upon at the time the Item was requested, unless revised availability or arrangements were made clear to the Item Manager.
    2. The Hirer may expect to sign a contract directly (if applicable) with the Item Manager prior to the handover of the hired Item.
    3. The Hirer may incur and be required to pay charges for insurance and other expenses if they are not covered by the Item Manager as specified in the Item listing details. Other expenses may include taxes (local, state and/or federal) and additional fees that are collected by the Item Manager but paid to the government or other institution. Compulsory costs must be displayed by the Item Manager when listing the Item. Other costs may include insurance upgrades, accessories hire and optional accessories hire. The Item Manager is not required to display optional costs when listing Items at askNextDoor. The Hirer will be required to pay for all the charges agreed with the Item Manager before the hire commencement.

  5. Cancellations
    1. Once your hire request is accepted, cancellations must be made directly to the Item Manager AND in your "askNextDoor profile" area. 
    2. The Item Manager may also operate with separate cancellation/no-show fees. Note that any associated fees of this nature which are imposed by the Item Manager are independent of askNextDoor's cancellation policy, and will be agreed to at the time of booking the Item.
    3. Failure to pick-up an Item after booking without notifying the Item Manager is considered a serious breach of askNextDoor's terms and conditions.
    4. Requesting item from askNextDoor's website without having any intention of completing the booking is considered a serious breach of askNextDoor's terms.
    5. When requesting an Item from askNextDoor's website, the Hirer accepts that askNextDoor can cancel or put on hold Hirer’s “askNextDoor profile” for any offence related to subsections 5.1, 5.3 and 5.4 of these terms and conditions.
    6. Sny dispute in regards to subsection 5.5 of these terms and conditions must be sent directly to askNextDoor by email at This email address is being protected from spambots. You need JavaScript enabled to view it. within 14 days from the date when the actions under subsection 5.5 were taken.

  6. No-shows and misuse of the askNextDoor Service
    1. Failure to pick-up the Item without notifying the Item Manager is considered a serious breach of the askNextDoor's terms and conditions and will be penalized with hirer’s “askNextDoor profile” being cancelled or temporary deactivated.
    2. Requesting Item from askNextDoor's website without having any intention of completing the booking is considered a serious breach of askNextDoor's terms and conditions and will be penalized with Hirer’s “askNextDoor profile” being cancelled or temporary deactivated.
    3. When requesting an Item from askNextDoor's website, the Hirer accepts that askNextDoor can at own discretion take actions under subsections 6.1 and 6.2 of these terms and conditions.
    4. Any dispute in regards to subsection 6.3 of these terms and conditions must be sent directly to askNextDoor by email at This email address is being protected from spambots. You need JavaScript enabled to view it. within 14 days from the date when the actions under subsection 6.3 were taken.

  7. Disclaimer of Warranty; Limitation of Liability
    1. AskNextDoor makes no representation or warranty about the suitability or reliability of an item or services provided by an Item Manager. askNextDoor does not perform any background checks or other investigation of Item Managers. Hirer should exercise independent discretion in determining the suitability of an Item.
    2. AskNextDoor’s liability for Services provided under these Terms and Conditions is limited to the sum of $50. AskNextDoor shall not be liable for special, incidental or consequential damages (including loss of profits), even if advised of the possibility of such damages.


Item Managers Responsibilities

  1. Membership
    1. It is free for an Item manager to register and list a relevant Item for hire on the askNextDoor website.
    2. AskNextDoor reserves the right to terminate an Item Managers membership or decline re-registration if that Item Manager has breached the terms and conditions as set forth in this document.

  2. Listing Items
    1. For any Item listed on askNextDoor, the Item Manager must allow the Hirer uninterrupted use of the Item for minimum period of 24 hours.
    2. The Item Manager is required to provide the most accurate information about each listing possible. This is inclusive of, but not limited to, anything that may be seen as a compulsory cost to the Hirer (i.e. essential accessories, insurance cost if not included in the hire fee). Any optional cost information such as optional accessories, upgrades, additional equipment hire etc. is also encouraged.
    3. Item managers can only list items that exist and are legally allowed and/or registered to be used in the state of the hire, and are legally allowed to be used by a third party (the Hirer).
    4. Item managers can at any time withdraw any listed Item as long as no hire booking has been accepted. Once a Hirer’s booking request has been accepted the Item Manager has committed to provide that Item to the Hirer, or find a mutually suitable alternative.
    5. In the case where Item Manager lists Item on behalf of owners all details must be provided to askNextDoor by the Item Manager or the Item Owner, and is the Item Managers responsibility to check the accuracy of the details for each Item listed. AskNextDoor takes no responsibility for the accuracy of this information or for the offer of free Items listed on askNextDoor???.

  3. Acceptance or rejection of Hirers
    1. It is entirely up to the discretion of the Item Manager to accept and reject Hirers.
    2. The Item Manager is required to accept or reject Hirer requests within 48 hours from the time the booking request is submitted by the Hirer. Repeated failure to do so can lead to disruption to, or in more severe cases cancellation of, askNextDoor registration and membership.

  4. Cancellations and no-shows
    1. An Item Manager is not subject to a refund if the no-show or cancellation of the hire is caused by the Item Manager not providing the Item to the Hirer, failure to inform about costs and charges (such as, but not limited to, deposits) or in any other way fails to provide essential information in the askNextDoor listing about the Item details. AskNextDoor accepts no responsibility for cancellations and/or no-shows caused by the Hirer, whether accidental or intentional.
